Why WSIB and COIs are the Hidden Project Risk for Ontario GCs

Every General Contractor in Ontario knows the drill: before a sub steps on site, you need their WSIB Clearance Certificate and a valid Certificate of Insurance (COI).

You collect them during onboarding, save them to a server folder, and give the green light. You are compliant, right?

Probably not.

The problem isn’t the documents you don’t have. The problem is the documents you think are valid, but aren’t. This is the hidden project risk—the gap between what’s in your folder and what’s happening on your job site today.

The “Set It and Forget It” Trap
#

Construction projects run for months or years. Compliance documents do not.

  • COIs expire: A sub’s insurance might renew in the middle of your project. If you don’t catch the expiry date, you are unknowingly employing an uninsured contractor.
  • WSIB status changes: A clearance certificate is just a snapshot in time. A subcontractor can be “Cleared” on Monday and “Not Eligible” on Tuesday due to missed premiums or an unreported injury.

If you are relying on a document you collected six months ago, you aren’t verifying compliance. You’re just archiving history.

The Cost of “Hidden” Non-Compliance
#

Why does this matter? Because in Ontario, the liability rolls uphill.

  1. WSIB Liability: Under the Workplace Safety and Insurance Act, if your subcontractor owes premiums, the WSIB can hold you (the principal) liable for their debt.
  2. OHSA Fines: In the event of an accident, Ministry of Labour (MOL) inspectors will demand proof of due diligence. “I thought they were cleared” is not a defence; a documented, recent check is.
  3. Audit Scramble: When a COR auditor or client requests a compliance report for a specific site, you shouldn’t have to spend three days digging through emails.

The Solution: Site-Level Visibility
#

The fix isn’t to hire more admin staff to stare at spreadsheets. The fix is to change how you view compliance.

Instead of asking, “Is this company compliant?”, ask: “Is this job site safe for tomorrow?”

This shift requires a system that moves faster than paper:

  1. Automated Expiry Tracking: Stop relying on Outlook calendar reminders. Use a system that alerts you 30 days before a COI expires.
  2. WSIB Refreshing: Don’t just check WSIB once. RosterSure auto-refreshes eligible accounts nightly to catch status changes the moment they happen.
  3. Project-Level Filtering: Your Project Managers don’t care about the 50 subs they aren’t using. They need a dashboard that shows only the subs active on their site right now.

Taking Control
#

You can’t manage what you can’t see. If your current process involves searching through three different inboxes to find a clearance certificate, you have hidden risk.

Start by auditing your active projects today. Look for “Stale” WSIB checks (older than 30 days) and COIs expiring this month. Those are your immediate risks.
